1. About these terms

These terms are an agreement between you and NEBRA Inc., doing business as NEBRA Apps (“we”, “us”), for your use of Truck Balance (the “Game”). By playing, you agree to them and to our Privacy Policy. If you do not agree, please do not play.

2. Who can play

You must be at least 13 years old (or the higher minimum age where you live). If you are under the age of majority, you must have permission from a parent or guardian, who is responsible for your use and purchases.

3. Your game and progress

The Game has no accounts. Your progress is saved on your device and, if you use them, in your device’s own backup services (iCloud Backup or a computer backup on iOS, Google backup on Android). We do not keep a copy of your progress. Progress may be lost if you delete the Game, turn these services off, or move between iOS and Android. We may reset or adjust progress that results from bugs, cheating or fraud.

4. Coins and virtual items

• Coins, items, lives and other virtual content (“Virtual Items”) are licensed to you, not sold. We grant you a limited, personal, non-transferable and revocable licence to use them in the Game.
• Virtual Items have no monetary value and cannot be exchanged for money or anything outside the Game, or transferred to other people.
• When you hold both purchased and earned coins, purchased coins are used first.
• “No Ads” and other purchases that unlock something permanently can be restored on the same App Store or Google Play account with Settings > Restore purchases. Coins and other used-up items cannot be restored.
• We may change the price, availability or behaviour of Virtual Items, for example to balance the Game.
• Purchases are final and non-refundable, except where the law requires otherwise (including the right of withdrawal below) or the store’s refund policy applies. Refunds for purchases made through the App Store or Google Play are handled by that store.
• Consumers in the EEA and UK — right of withdrawal: you have the right to withdraw from a purchase of Virtual Items within 14 days of the purchase. Before you buy, we ask you to agree that the Virtual Items are delivered to you immediately and to confirm that you will lose your right of withdrawal once you use them. To withdraw, contact the store you bought from or us before you use the Virtual Items; refunds are made with the same means of payment.

5. Ads

The Game shows full-screen ads after some levels, and offers optional video ads that you can choose to watch for a reward. Rewards are given after the ad has played as described in the Game. Buying “No Ads” removes the full-screen ads; the optional reward videos stay.

6. Rules of conduct

Do not cheat, use bots or modified clients, exploit bugs, interfere with the Game or other players, reverse engineer the Game except where the law allows, or use the Game for any unlawful purpose.

7. Availability, suspension and termination

We may update, change or stop the Game or parts of it. We may suspend or end your access if you seriously breach these terms. You may stop playing at any time. If the Game is permanently shut down, we will give reasonable notice in the Game.

8. Intellectual property

The Game and its content are owned by us or our licensors. You may use them only to play the Game under these terms.

9. Disclaimers and limitation of liability

The Game is provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, or our wilful misconduct or gross negligence, or your statutory rights as a consumer.

10. Governing law and disputes

These terms are governed by the laws of Japan, and the Tokyo District Court has exclusive jurisdiction in the first instance, except that consumers keep the protection of the mandatory laws and courts of the country where they live. Before any formal claim, please contact us so we can try to resolve the issue.

11. Changes to these terms

We may change these terms. We will show the new date above and, for important changes, tell you in the Game before they apply.

利用規約

1. この規約について

本規約は、トラックバランス（Truck Balance、以下「本ゲーム」）の利用について、皆さまとネブラ株式会社（NEBRA Inc.、アプリのブランド名 NEBRA Apps。以下「当方」）の間で適用されます。本ゲームを遊ぶことで、本規約とプライバシーポリシーに同意したものとします。同意されない場合は遊ばないでください。

2. 利用できる方

13 歳以上（お住まいの地域でそれより高い年齢が定められている場合はその年齢以上）の方が利用できます。未成年の方は保護者の同意を得てください。未成年の方の利用と購入は保護者が責任を負います。

3. ゲームの記録

本ゲームにはアカウントがありません。進み具合は端末と、お使いの場合は端末の標準のバックアップ（iOS は iCloud バックアップまたはパソコンへのバックアップ、Android は Google のバックアップ）に保存されます。当方は進み具合の写しを持ちません。本ゲームを削除したり、これらの機能を切ったり、iOS と Android の間で端末を替えたりすると、記録が失われることがあります。不具合・チート・不正による記録は、元に戻したり直したりすることがあります。

4. コインとゲーム内のアイテム

• コイン、アイテム、ライフなどのゲーム内のもの（以下「ゲーム内アイテム」）は販売ではなく、利用の許諾です。本ゲームの中で使える、個人的・譲渡できない・取り消しうる利用権を許諾します。
• ゲーム内アイテムに金銭的な価値はなく、お金や本ゲームの外のものと交換したり、他の人に譲ったりはできません。
• 購入したコインと獲得したコインの両方がある場合は、購入したコインから先に使われます。
• 「広告なし」など、いつまでも効く購入は、同じ App Store・Google Play のアカウントで「設定 > 購入の復元」から戻せます。コインなど使ってなくなるものは戻せません。
• ゲームのバランスのためなどに、ゲーム内アイテムの価格・提供・効き目を変えることがあります。
• 購入は確定し、法令で認められる場合（下の撤回権を含みます）や各ストアの返金方針による場合を除き、払い戻しはしません。App Store・Google Play での購入の返金は、各ストアが受け付けます。
• 欧州経済領域・英国の消費者の方（撤回権）：ゲーム内アイテムの購入から 14 日以内であれば、購入を撤回できます。購入の前に、ゲーム内アイテムがすぐに届けられることへの同意と、それを使うと撤回権がなくなることの確認をお願いします。撤回するときは、ゲーム内アイテムを使う前に、購入したストアまたは当方にご連絡ください。返金は購入と同じ支払い方法で行います。

5. 広告

本ゲームは、ステージの合間に全面広告を出します。また、ごほうびのために見るかどうかを選べる動画広告があります。ごほうびは、本ゲームに示したとおり広告を見終わった後にお渡しします。「広告なし」を買うと全面広告が消えます（見るかを選べる動画は残ります）。

6. 禁止事項

チート、ボットや改変したアプリの使用、不具合の悪用、本ゲームや他のプレイヤーの妨害、法令で認められる場合を除く解析、違法な目的での利用を禁じます。

7. 提供・停止・終了

本ゲームの全部または一部を更新・変更・終了することがあります。本規約への重大な違反があった場合は、利用を止めたり終了したりすることがあります。本ゲームの提供を終えるときは、本ゲーム内で相当の期間をおいてお知らせします。

8. 知的財産

本ゲームとその内容の権利は当方または許諾者にあります。本規約に従って遊ぶためだけに使えます。

9. 免責と責任の制限

本ゲームは現状のまま提供します。法令で認められる範囲で、当方は間接的な損害の責任を負わず、当方の責任の総額は、請求の前 12 か月にお支払いいただいた金額を上限とします。ただし、当方の故意・重大な過失による損害、人の生命・身体の損害など法令で制限できない責任や、消費者としての法律上の権利（消費者契約法などに基づくものを含みます）を制限するものではありません。

10. 準拠法と紛争

本規約は日本法に従い、東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、消費者の方はお住まいの国の強行法規と裁判所による保護を失いません。正式な請求の前に、まずご連絡ください。解決に努めます。

11. 規約の変更

本規約を変更することがあります。上の日付を更新し、重要な変更は適用の前に本ゲーム内でお知らせします。
